D66 calls on the minister to revise the legislation on legitimate portion
Vera Bergkamp (D66) is calling on the Minister for Legal Protection, Sander Dekker, to revise the current legislation on the statutory portion. This is in response to a recent report from the Center for Notarial Law. The researchers recommended abolishing the statutory portion.
Bergkamp is making her appeal through written questions to the minister. She wants him to address, among other things, the fact that, according to research, 76 percent of (candidate) civil-law notaries oppose the statutory portion. This is the portion of the inheritance to which a child remains entitled despite disinheritance. She also believes that surveys among the Dutch public show that the statutory portion in its current form receives little support.
No need
This isn't the first time Bergkamp has called on the cabinet to abolish the statutory portion. Last September, Dekker responded by saying that there was no "urgent and widely supported need to abolish the statutory portion." Bergkamp now wants to know whether he still feels the same way after this investigation and is once again calling on him to amend the current legislation.
