A will generates money and prevents major misery
If you haven't made a will, you don't decide who inherits what. The legislature then determines who your heirs will be and how much inheritance tax must be paid. If you want to stay in control, make a will. This can save you a lot of money and prevent major problems.
If you also want to prevent losing control if you can no longer express your wishes due to an accident or illness, a notarial living will grants power of attorney to a trusted person to arrange everything for you, including finances, practical matters, and medical matters. This will prevent your loved ones from getting hopelessly stuck and incurring significant costs to arrange everything for you and your loved ones through the courts.
"As a notary, I find it very sad to see again and again what kind of misery unintentionally arises when people do not put their affairs in order or do not put them in order on time," says notary Janssen.
If parents don't have a will, the surviving parent and the children automatically become the heirs. The children simply have to wait to receive anything until the surviving parent also passes away. "This can lead to a financial disaster. After all, the surviving spouse has to pay inheritance tax on the children's inheritance within a few months of their partner's death. But how can you afford that if the majority of your assets are tied up in your partially paid-off home? During the information session, we will explain the available solutions and how you can prevent such dire situations by making a will and a living will," Janssen reassures.
Many people don't consider the financial consequences of death, illness, or an accident. Or they don't understand the legal implications. Which I can certainly understand. Or they put it off. It'll happen later. And then, during their lifetime, they're unexpectedly and unforeseenly overtaken by an accident, illness, or death. And then all hell breaks loose. And that's a terrible shame. Because it's so easy to prevent things from going unnecessarily off track. That, after death, all sorts of family relationships are unintentionally strained and relationships are unnecessarily and irreparably damaged. That your heirs have to pay an unnecessary amount of inheritance tax. That your assets go to someone else, while you might have wanted to bequeath a sum to a good cause, for example, Support Casper (Foundation for Surviving Pancreatic Cancer)."
Janssen: "We can offer our clients an accessible, personal, and dedicated service, and arrange everything together cost-effectively. This often provides the client and their loved ones with peace of mind, security, and a significant financial return. And it prevents significant distress. That is also our legal duty as notaries."
