Once again fewer cases for the Disputes Committee
The Disputes Committee again handled fewer disputes in 2023 than the previous year. In total, the Notarial Committee handled 60 cases, compared to 74 in 2022. The Notarial Business Committee handled 4 cases: 4 fewer than the previous year. In 2022, the number of cases for both committees was already lower than in 2021. The committee does not provide a reason for this decrease.
The Notary Commission handles consumer complaints against notaries. Of the 60 cases handled, 34 were filed in 2023, according to the annual report . Most disputes concerned, among other things, the quality of service, the notary's actions, and the (amount of) the notary's invoice.
Final statements
The committee issued a final ruling in 36 cases. Twelve of these cases found (partially) in the client's favor. In the vast majority of cases, the client was unsuccessful. At the end of 2023, 13 cases remained open for further processing.
Business complaints
Of the four cases handled by the Notary Business Commission last year, only one was actually filed in 2023. These were cases involving civil-law notaries versus entrepreneurs, and vice versa. According to the annual report, the commission issued two final rulings last year. In one case, the client was (partially) successful, and in the other, the client was unsuccessful. At the end of the year, one case remained open for further processing in 2024.
Notary Dispute Committees
The notary's office has been affiliated with the Disputes Committee since March 2013. Clients can easily submit disputes here regarding the quality of the notary's services, the amount of invoices, and claim damages of up to €10,000. Notaries can also appeal to the Disputes Committee for outstanding invoices. If the client is a consumer, they must consent to the Disputes Committee handling the dispute.
