KNB asks the minister for support for the use of digital resources in emergency situations

The Royal Dutch Association of Civil-Law Notaries (KNB) has asked Minister for Legal Protection Sander Dekker to allow civil-law notaries to use digital and audiovisual resources in emergency situations when executing notarial deeds. The KNB believes this is necessary to eliminate any legal misunderstandings.

The Royal Netherlands Notary Association (KNB) believes (pdf, 126 kB ) that the Civil-Law Notaries Act (Wna) allows civil-law notaries to use audiovisual aids in exceptional circumstances, provided they properly explain their decision in their records. The current situation surrounding the coronavirus, which can cause COVID-19, is one such exceptional situation. The KNB believes this approach aligns with the civil-law notary's role, as he or she is at the heart of society and must enable litigants, even in an emergency, to properly record agreements and wishes in a notarial deed. This applies not only to wills but also to other deeds.
