Buyers of new construction worried after Council of State ruling
The Dutch Homeowners' Association (VEH) received many questions from worried buyers of new-build homes following the Council of State's nitrogen ruling. The ruling's implications for new-build projects depend on the buyer's current stage of development.
If an irrevocable environmental permit has been issued, the ruling has no consequences. An irrevocable permit means that objections and appeals are no longer possible. However, it is important for buyers to ensure that this permit is in place before going to the notary.
Delay
According to VEH, the ruling does impact new construction projects that do not yet have an irrevocable environmental permit. Such projects may be delayed or even cancelled. Nitrogen reports may be required for these projects. Whether this is necessary depends on factors such as nearby nature reserves, the size of the construction project, and the construction equipment to be used.
