Belgium recognizes Dutch living wills as of January 1
Belgium ratified the Hague Convention on the Protection of Adults 2000 on September 30, 2020. The convention will enter into force on January 1, 2021. This means that living wills signed in the Netherlands will also be recognized in Belgium.
After its entry into force, the treaty will serve as the basis in Belgium for recognizing health care proxies/living wills and other similar documents signed abroad.
Situation in the Netherlands
The Netherlands signed the treaty in 2000, but has not yet ratified it. The Royal Dutch Association of Civil-Law Notaries (KNB) supports the European Union's (EU) call for ratification. The treaty is intended, among other things, to establish clear international rules regarding the recognition of living wills in international situations. It is currently unclear in which non-treaty countries a living will is recognized.
