Emergency law automatically extended every 2 months

The emergency law that allows for the remote execution of deeds in very exceptional circumstances is automatically extended by two months each time. The extension will only be terminated if the Royal Dutch Association of Civil-Law Notaries (KNB) indicates that this temporary measure is no longer necessary.

Article 26 of the Emergency Act allows, in exceptional circumstances, the drawing up of deeds by notary via electronic means of communication. The Ministry of Justice and Security has indicated that this article will be automatically extended every two months, until the Royal Netherlands Bar Association (KNB) indicates that this is no longer necessary. If the article is to be repealed, the Ministry will announce this two months in advance.

Don't wait
Until this announcement is made, notaries can continue to use Article 26 whenever necessary and desired. A notary therefore doesn't have to wait for the publication of the extension decision to be certain whether the temporary measure will be extended or not.

Extend
The decision to extend the measures until December 1, 2020, is expected to appear in the Government Gazette shortly before the end of this month.
