Notarial chain partners propose introduction of 'Sustainable Building Rights'

How can you establish a building right for a heat pump or solar panels? This is the subject of the proposal to introduce the "Sustainable Building Right" in the Land Registry (BRK). The proposal was developed with input from the Land Registry, the University of Groningen, Olenz Notaries, and the Royal Dutch Association of Civil-Law Notaries (KNB).

When making a building more sustainable by installing, for example, a heat pump, a heat and cold storage system, or solar panels, a building right is often established for the financier, landlord, or operator of the installation. These building rights can currently be registered in the BRK in different ways: as a "normal" building right or as a "utility building right." As a result, the sustainable nature of a building right is often not sufficiently recognizable. This proposal will increase the recognizability of such a sustainable installation in the BRK.

Increase insight
The proposed amendment to the Land Registry Decree would make a building right for a sustainable installation recognizable in the BRK (Register of Buildings), improving the transparency of the BRK. A uniform designation of building rights in the BRK relating to sustainable installations simplifies the financing process and reduces transaction costs by immediately making it clear what the building right pertains to.
