Environmental Act in force from 1 January 2024

The decision has been made: the Environment and Planning Act will come into effect on January 1, 2024. The Senate approved the law's entry into force this week. The problems with the digital system supporting the law, which had already led to five postponements, have now been largely resolved.

The purpose of the Environment Act is to prevent the fragmentation of various spatial planning laws. These laws are important for, among other things, the transfer of real estate. This should make it easier to apply for permits.  

Notarial investigation obligation
ICT wasn't the only problem with the implementation of the Environment Act. Annerie Ploumen, chair of the Royal Dutch Association of Civil-Law Notaries (KNB), previously pointed out to De Jonge the consequences of the removal of the notarial investigation requirement for several public-law restrictions upon the new Environment Act's implementation. This means that some of the notarial consumer protections will be lost. According to De Jonge, this could be solved with a consumer brochure.
