KNB responds to bill for charging points at homeowners' associations
The bill, the "Notification Regulation for Charging Points by Owners' Associations Act," aims to make it easier to install charging points for electric vehicles in private parking spaces or in shared parking areas near apartment complexes. It will also soon be possible to establish a building right for a charging point for electric vehicles on or adjacent to shared areas. The Royal Dutch Association of Civil-Law Notaries (KNB) broadly agrees with the proposal, but has some reservations.
In its response (pdf, 158 kB) to the consultation, the Royal Dutch Association of Building Builders (KNB) endorses the importance of implementing such a notification system. The infringement of apartment owners' property rights is acceptable due to the overarching goal achieved by the bill : uniform regulations for all Owners' Associations (VvE) regarding sustainability.
Limited
As a member of the Modernization of Dutch Apartment Law working group, the KNB regrets that the Minister of the Interior and Kingdom Relations is limiting the regulation to charging points. The bill could have included more rules for homeowners' associations, as proposed by the working group.
Measure
Another point the KNB raises is that the necessary General Administrative Order (AMvB) is missing from this consultation. This decision was made because parliamentary consideration of a bill takes longer than that of a measure. Therefore, the bill has already been submitted for consultation. The KNB would have preferred to wait until the AMvB had been finalized.
