Notary as assistance in drawing up a surrogacy agreement

A new law aims to ensure the proper (legal) handling of surrogacy. The bill submitted by the Minister for Legal Protection, Franc Weerwind, requires the drafting of a surrogacy agreement under the supervision of a legal expert. This could be a notary, for example.

Current legislation and regulations do not provide a specific framework for surrogacy. Therefore, Weerwind has now submitted the bill for the Child Surrogacy and Descent Act . A key point is that the surrogacy agreement is carefully drafted. Both the surrogate mother and the intended parents are guided in drafting this agreement by an independent legal expert. Weerwind is considering this expert to be a lawyer or notary.
