Environmental Act postponed until July 1, 2023

The implementation of the Environment and Planning Act has been postponed again. Due to IT issues, implementing the law on January 1st is not responsible. Hugo de Jonge, Minister for Housing and Spatial Planning, wants to further test the IT system and is now targeting implementation on July 1, 2023.

The implementation of the Environment Act has already been postponed several times. This time, the January 1st implementation date was met with objections from the Interprovincial Consultation (IPO). According to the consultative body, not all elements of the instruments important to the province have yet been tested. Therefore, De Jonge has decided to free up more time for testing and practicing with the new system.

Goal
The purpose of the Environment Act is to prevent the fragmentation of various spatial planning laws. These laws are important for, among other things, the transfer of real estate. This should make it easier to apply for permits.

Notarial investigation obligation
The software isn't the only issue with the new Environmental Act. Annerie Ploumen, chair of the Royal Dutch Association of Civil-Law Notaries (KNB), previously pointed out to De Jonge the consequences of the removal of the notarial investigation requirement for several public-law restrictions upon the new Environmental Act's implementation. This means that some of the notarial consumer protections will be lost. According to De Jonge, this could be resolved with a consumer brochure.
