Leasehold rights in Vlaardingen expire
For many leaseholders in the municipality of Vlaardingen, hereinafter: the "municipality," their leasehold rights expire between 2025 and 2029. They received a letter from the municipality on February 20, 2023, informing them of the new leasehold policy that took effect on April 1, 2023.
Because the municipality is keen to help leaseholders make a choice, it contacted them again on May 30th and made them a personalized offer, including a form for the leaseholder to complete.
The leaseholder had the choice between:
- The delivery of the bare ownership by the municipality to the leaseholder (which would give the leaseholder full ownership and in which the leasehold right is extinguished by mixing); or
- The conversion of the temporary leasehold right into perpetual leasehold to which the General Leasehold Conditions 2014 ("AEV 2014") apply.
In addition, the leaseholder can use the form to select a notary to handle the conversion or transfer of bare ownership. We are happy to assist leaseholders in Vlaardingen.
Contract of assignment with quotation

Mortgage
Modifying a leasehold—terminating the leasehold in exchange for the issuance of a new leasehold—entails that the mortgagee (usually a bank) who financed the old leasehold can demand a new mortgage on the newly issued leasehold. Banks handle this process differently, but in many cases, it results in significant costs for the leaseholder. We wanted to avoid this for the leaseholders in the municipality. Therefore, we advised the municipality not to reissue a leasehold followed by the establishment of a new leasehold, but to convert the existing temporary leasehold into a perpetual leasehold. This often prevents the leaseholder from having to establish a new mortgage, saving them thousands of euros. Many mortgage holders allow us to only ask them for written permission for the conversion when a conversion is made.
Information meeting
On Wednesday, June 7, 2023, the municipality, supported by expertise from the notary profession, will organize an information meeting for leaseholders at 7:00 PM at the Church of the Nazarene, Zwanensingel 1, 3136 GZ Vlaardingen. Discount scheme
In many cases, homeowners (including leaseholders) want to avoid being forced to leave their home when a relationship ends due to death or divorce, for example, because their heirs or those of their (ex-)partner could claim their inheritance. Or they want to prevent a situation where, if a partner unexpectedly becomes incapacitated, for example, due to an accident or illness, everything would essentially grind to a halt, and the court would appoint a complete stranger who would then interfere with your money, medical treatment, and personal circumstances. Which is perhaps not what you want at all. We can ensure that you maintain full control, and that you and your loved ones don't get into trouble.
We can support you, for example, by guiding you in drafting prenuptial agreements, partnership agreements, cohabitation agreements, and/or wills and/or living wills (powers of attorney).
