Proposal for 'Sustainable Building Rights' submitted to the ministry
Who owns the solar panels or the heat pump? This isn't always the case with the building itself. To distinguish this type of ownership from other building rights, a proposal is being made to introduce a "Sustainable Building Rights" (Opstalrecht duurzaam) in the Land Registry (BRK). This proposal will soon be submitted to the Ministry of the Interior and Kingdom Relations.
The proposal was developed with input from the Land Registry, the University of Groningen, Olenz Notaries, and the Royal Dutch Association of Civil-Law Notaries (KNB). A possible introduction of the "Sustainable Building Rights" label in the BRK would increase the recognition of a sustainable installation in the BRK. Currently, items like solar panels or a heat pump are registered as "normal" building rights or as "utility building rights."
Cheaper
The Land Registry expects to be able to provide more clarity and less expensive information about the rights and obligations associated with a plot of land. Requesting and interpreting deeds, because it's currently not always clear what constitutes a "utility building right," for example, is expensive.
