Support from the Council of Ministers for the KNB's position on digital passing
The Cabinet will likely decide tomorrow to support the Royal Dutch Notary (KNB)'s position on digitally executing deeds in emergency situations. The discussion on this support is part of a package of measures scheduled for the Cabinet's agenda on Friday, the Ministry of Justice and Security informed the KNB.
The Royal Netherlands Notary Association (KNB) believes that the Civil-Law Notaries Act (Wna) allows civil-law notaries to use audiovisual aids in exceptional circumstances, provided they properly justify their use in their records. The current situation surrounding the coronavirus, which can cause COVID-19, is one such exceptional situation. The KNB believes this approach aligns with the role of civil-law notaries, who are at the heart of society and must enable litigants, even in an emergency, to properly record agreements and wishes in a notarial deed.
Proposal
Last week, the Royal Netherlands Bar Association (KNB) sent a letter to Minister for Legal Protection Sander Dekker regarding the use of digital means for the execution of deeds. This was prompted by questions raised in notarial practice. The Ministry of Justice and Security worked diligently with the KNB last week on a proposal for the Council of Ministers.
