European lobby effective: deregulation of the job
The notary profession will not be included in the list of professions eligible for further deregulation. This has been confirmed by French European Commissioner for the Internal Market Thierry Breton. This demonstrates the effectiveness of the lobbying efforts of the Royal Notarial Association (KNB), in collaboration with the Council of Notaries in Europe (CNUE), against the initiative of the European Commission's Directorate-General for Public Works and Water Management (GROW).
The Royal Netherlands Bar Association (KNB) , the CNUE, and several individual EU Member States previously objected to the European Commission's intention to further deregulate, among other things, the notary profession. The KNB considered this intention incompatible with EU law. In 2005, 2013, and 2018, the EU legislature repeatedly decided to explicitly exclude notaries from the Services Directive, the Professional Qualifications Directive, and the Proportionality Directive.
Defense
Meanwhile, the relevant directorate has also stated in writing (pdf, 209 kB) that the notarial profession will not be included in the appeals to be assessed. However, the European Commission's goal of an internal market without unfair or disproportionate barriers remains unchanged. If other initiatives are developed that threaten the notarial profession, the KNB will not hesitate to defend itself again.
